Public Notice: Environmental Quality Council Hearing, Solid Waste Rules and Regulations Chapters 4 and 6                                                  

The Water and Waste Advisory Board will consider proposed revisions to Wyoming Department of Environmental Quality (WDEQ) Solid and Hazardous Waste Division (SHWD) Solid Waste Rules and Regulations Chapter 4, Construction and Demolition Landfill Regulations and Chapter 6, Transfer, Treatment and Storage Facility Regulations, at a public meeting to be held on March 29, 2018 in the main conference room at the Casper office of the Department of Environmental Quality, 152 North Durbin Street, Suite 100, Casper, Wyoming, commencing at 9:00 a.m. (MST).

Public Notice: Environmental Quality Council Hearing, Storage Tank Program Chapter 1 and Water Quality Rules and Regulations Chapters 17 and 19

The Wyoming Environmental Quality Council (EQC) will consider proposed revisions to Wyoming Department of Environmental Quality (WDEQ) Water Quality Division (WQD) Rules and Regulations Docket 18-3101 and Solid and Hazardous Waste Division (SHWD) Storage Tank Program Rules and Regulations Docket 18-5101 at a public hearing to be held on May 23, 2018, at the Wyoming Game and Fish Building, Elk Room, 5400 Bishop Blvd., Cheyenne, Wyoming, commencing at 9:00 a.m. (MDT).

SHWD, pursuant to the authority vested in it by the Environmental Quality Act, Wyoming Statute (W.S.) § 35-11-1416, proposes to move Chapter 17 from WQD Rules and Regulations to SHWD, Storage Tank Program - Chapter 1, Storage Tanks.  The Storage Tank Program was moved from the WQD to SHWD during the 2017 legislative session.  The proposed revisions: 1) are in response to changes made to the federal law and meet federal law requirements; 2) update and standards, publications, and references; 3) make editorial, formatting, and technical corrections; 4) provide aboveground storage tank owners and/or operators the option of obtaining financial assurance; and 5) move WQD Chapter 19 (Financial Assurance for Underground Storage Tanks) into this Chapter 1.

The revised rules meet minimum substantive state statutory requirements in accordance with W.S. § 16-3-103(a)(i)(G). The Department has evaluated the revised rules in accordance with W.S. § 9-5-304, and interested persons may inspect a copy of that evaluation and the proposed rule package at: Department of Environmental Quality, Storage Tank Program, 200 W. 17th Street, Suite 120, Cheyenne, Wyoming. The EQC will consider the proposed rules, written and electronically filed comments, WDEQ’s Analysis of Comments, and any modifications proposed by the WDEQ to the draft rules. At the public hearing, statements that focus on previously received comments, the WDEQ’s Analysis of Comments, and issues raised by the analysis will be accepted. The EQC will determine if the record will remain open beyond the close of the scheduled hearing. The EQC may, however, close the record and make a final decision regarding the rules at the conclusion of the hearing.

Comments on the proposed revisions may be submitted beginning March 19, 2018, and ending at 5:00 p.m. (MDT) on May 4, 2018. Written comments should be sent to the Wyoming Department of Environmental Quality, 200 W 17th St, Cheyenne, Wyoming, 82002 or faxed to (307) 635-1784. Electronic comments may only be submitted through and accepted by the WDEQ comment portal at WDEQ will file an analysis of comments with the EQC prior to the May 23, 2018, public hearing. The proposed rules, comments submitted, and the analysis of comments will be posted on the EQC website at under Docket #18-5101.

Any person wishing to use a digital presentation during their testimony before the EQC must provide a digital copy to the EQC no less than three (3) days prior to the hearing unless they contact the EQC and request an extension for good cause. Failure to submit a timely digital copy will result in the person not being allowed to use the presentation during their testimony.
