Ownership Change Forms

Did you know that Ownership Change Forms should be filled out when facility acquisitions occur and/or company name changes take place? The Air Quality Division has attached the Change of Ownership Forms for Minor Sources and Title V Facilities below for your convenience. These forms need to be completed and mailed to the following address:

It is important to submit completed ownership changes in a timely manner as IMPACT portal users will not have access to newly-acquired facilities until the completed forms are received and processed.

Asbestos

The Wyoming Asbestos Program enforces the state asbestos regulations for asbestos inspections and abatement projects. Program staff visit sites based on complaints, visit projects found as drive-by’s where no notification had been received, and they also visit projects where notifications have been received to check on contractor work practices. Program staff also provides clarification when the regulations appear unclear.

Program staff can answer questions and provide referrals for other indoor air quality issues; such as mold, radon, lead-based paint, formaldehyde; even though the State has no regulations to address these concerns.

Asbestos Building Inspectors

Inspectors and inspections performed in public and commercial facilities are governed by the Environmental Protection Agency's Asbestos School Hazard Abatement Reauthorization Act (ASHARA) and the accompanying federal regulations. Federal regulation requires that a trained Asbestos Building Inspector performs inspections of public and commercial facilities before the start of a renovation or demolition project. The Asbestos Building Inspector should be able to provide you with a copy of their current training certificate. 

There is no registration or licensure program in Wyoming, and for that reason, there is no list of trained Asbestos Building Inspectors in this state. To find trained Asbestos Building Inspectors from Wyoming, we suggest that you search yellowpages.com under the keywords "asbestos detection" or "asbestos removal" in larger cities close to the location of your project. In addition, the states around Wyoming, except for Idaho, have registration and licensure programs, and you may be able to locate an Asbestos Building Inspector in another state that would be willing to perform inspections in Wyoming. 

Please be aware of the potential for conflict of interest if you hire someone from an asbestos abatement firm to perform an inspection or collect samples.

A thorough asbestos inspection is only required to be performed in the portion of the facility where the renovation or demolition work will occur. If samples are collected for testing, the inspection report should indicate which materials contain asbestos and their locations in the facility.

Asbestos in Homes

Private residences can contain just as many asbestos-containing building materials as public and commercial buildings. Wyoming's asbestos regulations do not require homeowners to obtain asbestos inspections in private residences prior to renovations or demolition, unless the renovation or demolition activity is being performed to allow the property to become public or commercial. Nevertheless, we strongly recommend that you hire a trained Asbestos Building Inspector to collect samples and test any suspect material prior to disturbance.

Asbestos Definitions

Demolition means the wrecking or taking out of any load-supporting structural member of a facility together with any related handling operations or the intentional burning of any facility.

Facility means any institutional, commercial, public, industrial, or residential structure, installation, or building (including any structure, installation or building containing condominiums or individual dwelling units operated as a residential cooperative, but excluding residential buildings having four or fewer dwelling units); any ship; and any active or inactive waste disposal site. For the purposes of this definition, any building, structure, or installation that contains a loft used as a dwelling is not considered a residential structure, installation, or building. Any structure, installation or building that was previously subject to this section is not excluded, regardless of its current use or function. 

Regulated Asbestos-Containing Material (RACM) means: (a) Friable asbestos material, (b) Category I nonfriable ACM that has become friable, (c) Category I nonfriable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or (d) Category II nonfriable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by this subpart.

Renovation means altering a facility or one or more facility components in any way, including the stripping or removal of RACM from a facility component. Operations in which load-supporting structural members are wrecked or taken out are demolitions.

Notification Requirements

The State of Wyoming does not have a required notification form as long as the information required in the regulation is provided to the Wyoming Asbestos Program, but a form is available below in a Word or Excel format. The notice can be provided by any entity involved in the project, but the form “belongs to” the entity that first provides it. 

We recommend that the form be emailed [asbestos.notice@wyo.gov] or faxed [307-777-6937]as soon as it is complete. Then it must be followed by a hard copy through a mail service. The form must be provided to the program at least 10 working days prior to the start of any renovation activity that will create or disturb Regulated Asbestos-Containing Material (RACM) and 10 working days prior to the start of any demolition activity in a facility. 

Changes to the form must be made in writing, but they can be either hand- or type-written on letterhead and faxed or sent in an email that includes entity contact information.

Registration and Licensure

There is no registration or licensure program for companies or individuals in the State of Wyoming. We do require that each person performing or supervising an asbestos project have a copy of their current AHERA-type training certificate with them at the project site during the entire length of the project. We do not accept cards given out by other states, because we do not have the paperwork to back them up. 

The training must have been given by a training provider that is accredited through another agency’s accreditation program.

Training Courses

There are currently no asbestos training providers with an office physically located in Wyoming. We allow persons who will perform work in Wyoming either to attend courses out of state given by training providers accredited through another agency’s program, or an accredited training provider can come into the state to teach.

There are no training topics specific to the State of Wyoming’s asbestos regulations.
